This page serves as Gamer Fresh's standing disclosure and good-faith commitment to compliance with New York State Law S.8420-A and any related AI advertising legislation. It is our proactive record of how we approach the use of AI-generated content in our advertising and marketing.
How Gamer Fresh Uses AI in Advertising
Gamer Fresh may use generative AI tools to create visual assets — including stylized human-like figures, characters, and models — in our commercial advertising and marketing materials. These assets are synthetic performers: digitally created figures that do not represent any real, identifiable person.
We use these tools intentionally and creatively, consistent with our brand identity as a performance-first lifestyle brand at the intersection of gaming, technology, and real-world living.
Our Compliance Approach
Because digital advertising platforms do not always allow advertisers to guarantee the geographic exclusivity of ad delivery, Gamer Fresh cannot always confirm with certainty whether a specific advertisement was viewed by a consumer in any particular state. Rather than apply disclosures selectively, we adopt a universal transparency posture: this page serves as our standing, conspicuous disclosure for all advertising creatives that feature AI-generated synthetic performers, regardless of platform or geography.
Where platform-level AI disclosures are required or available — such as on TikTok — we utilize those tools as an additional layer of transparency. Our storefront disclosure page supplements, and in many cases precedes, those platform-level requirements.
We believe this approach reflects both the spirit and intent of emerging AI advertising legislation, and we are committed to updating our practices as the regulatory landscape evolves.
About New York State Law S.8420-A
Enacted in December 2025 and effective June 9, 2026, S.8420-A requires advertisers with actual knowledge of a synthetic performer's inclusion in a commercial advertisement to provide a clear and conspicuous disclosure. Key provisions include:
- Scope: Applies to advertisers with actual knowledge of synthetic performer use. Does not apply to media outlets or publishing platforms.
- Exemptions: Expressive works (e.g., video games, films) where synthetic performer use is consistent with the work; audio-only ads; AI used solely for language translation.
- Format: The law does not mandate a specific disclosure format — it must be conspicuous. Gamer Fresh treats this standing page as that conspicuous disclosure.
- Penalties: $1,000 for a first violation; $5,000 for subsequent violations.

New York S.8391, effective immediately, requires consent from heirs or executors before using the name, voice, or likeness of a deceased New York resident for commercial purposes. Gamer Fresh does not use the likeness of any deceased individual in our advertising without appropriate authorization, and we are committed to full compliance with this law.
